TERMS OF SERVICE
These Terms of Service (“Terms”) govern your participation in any services offered by Happy Place Pilates. By booking, purchasing, attending, or participating in any service, you agree to be legally bound by these Terms.
1. Assumption of Risk
You understand and acknowledge that Pilates and fitness activities involve inherent risks, including but not limited to muscle strain, joint injury, dizziness, falls, and other physical injuries. You voluntarily assume all risks, known and unknown.
2. Medical Clearance & Representation
You represent and warrant that:
You are physically able to participate in exercise activities
You have consulted a medical professional if needed
You will immediately stop if you experience pain, dizziness, or discomfort
Happy Place Pilates is not responsible for injuries resulting from undisclosed conditions or failure to follow instructions.
3. Waiver & Release of Liability
To the maximum extent permitted by New Hampshire law, you hereby release, waive, discharge, and hold harmless Happy Place Pilates, its owners, employees, contractors, instructors, and affiliates from any and all claims, demands, damages, injuries, or causes of action arising from participation, including negligence.
4. Indemnification
You agree to indemnify and defend Happy Place Pilates against any claims, liabilities, damages, losses, and expenses (including attorney’s fees) arising out of your participation, misconduct, or breach of these Terms.
5. Payment, Memberships & Refunds
All sales are final unless otherwise stated in writing
Memberships and class packages are non-transferable
Expiration dates are strictly enforced
No refunds for missed classes, late cancellations, or no-shows
We reserve the right to change pricing and packages at any time.
6. Studio Policies
Late arrivals may be denied entry without a refund.
Proper attire and respectful conduct are required.
We reserve the right to refuse service to anyone for safety or policy violations.
7. Intellectual Property
All content, branding, class formats, and materials are the exclusive property of Happy Place Pilates and may not be reproduced without written permission.
8. Force Majeure
We are not liable for delays, cancellations, or interruptions caused by events beyond our control, including but not limited to weather, natural disasters, power outages, or government actions.
9. Governing Law & Venue
These Terms shall be governed exclusively by the laws of the State of New Hampshire, without regard to conflict-of-law principles. Any dispute shall be resolved solely in New Hampshire courts.
10. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
11. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and Happy Place Pilates and supersede all prior communications or agreements.
By participating in services at Happy Place Pilates, you acknowledge that you have read, understood, and agreed to these policies in full.
